DMCA & Copyright Policy
Quick summary: Theme Canal LLC complies with 17 U.S.C. § 512 and the Digital Millennium Copyright Act (DMCA). If you believe your copyrighted work is available on or through themecanal.com without permission, you can send us a valid DMCA notice.
We review genuine notices in good faith and, where appropriate, remove or disable access to the material within a reasonable time.
1. Scope & compliance
Theme Canal LLC responds to properly formatted notifications of claimed copyright infringement under 17 U.S.C. § 512 and other applicable intellectual property laws.
If you are a copyright holder (or authorized to act on behalf of one) and believe that material available on or through themecanal.com infringes your rights, you may request its removal or the disabling of access to it by submitting a DMCA notice as described below.
2. Requirements for a valid DMCA notice
Your written DMCA notification must include all of the following elements:
- Authorized party details: Identification of the copyrighted work owner and clear evidence that you are authorized to act on their behalf.
- Contact information: Your full name, mailing address, and a valid email address (and optional phone number) so we can reach you.
- Identification of the work: A description of the copyrighted work you claim has been infringed.
- Location of the material on themecanal.com: One or more clickable, direct URLs to each page or file on themecanal.com where the allegedly infringing material appears. General references (for example, “your site” or a homepage URL) are not sufficient.
- Good-faith statement: A clear statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- Accuracy & authority statement: A statement that the information in the notice is accurate and, under penalty of perjury, that you are the copyright owner or authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
- Signature: A physical or electronic signature of the owner or the person authorized to act on behalf of the owner of the exclusive right allegedly infringed (for example, typing your full legal name at the end of the notice).
Incomplete notices may be rejected or delayed until all required information is provided.
3. Submitting your DMCA notice
Send your complete written DMCA notice to:
- Email: [email protected]
To help us process your notice efficiently, please:
- Include “DMCA Notice” in the subject line of your email.
- Provide clickable direct links to each specific page or file containing the material in question.
- Submit your notice in English where possible.
Please allow 1–2 business days for an initial response. Contacting third parties such as our hosting provider instead of us may delay resolution.
4. How Theme Canal handles DMCA notices
Upon receiving a valid DMCA notice, we may take one or more of the following actions:
- Remove or disable access to the allegedly infringing material.
- Notify the user or account associated with the material, where applicable.
- Request additional information from the complaining party if the notice is incomplete or unclear.
We aim to act on genuine, complete notices as quickly as reasonably possible, typically within 48 hours of confirmation. However, timing may vary depending on volume and complexity.
5. Counter-notice (for users whose content is removed)
If your content has been removed due to a DMCA notice and you believe this was a mistake or that you are authorized to use the material, you may send us a counter-notification that includes:
- Your full name, address, telephone number, and email address.
- Identification of the material that has been removed or to which access has been disabled and the location at which it appeared before removal.
- A statement, under penalty of perjury, that you have a good faith belief the material was removed or disabled as a result of mistake or misidentification.
- A statement that you consent to the jurisdiction of the courts in your primary place of residence (or, if outside the U.S., to the jurisdiction of a court where Theme Canal may be found) and that you will accept service of process from the person who provided the original DMCA notice or their agent.
- Your physical or electronic signature.
Send counter-notices to [email protected] with “DMCA Counter-Notice” in the subject line.
6. Misrepresentations & legal considerations
Please be aware that, under the DMCA, parties who knowingly misrepresent that material is infringing (or was removed in error) may be liable for damages, costs, and attorneys’ fees resulting from such misrepresentation.
Nothing on this page is legal advice. If you are unsure whether a particular use of copyrighted material is lawful, we strongly recommend consulting with a qualified attorney before submitting a notice or counter-notice.
7. Important additional information
- Because of technical limitations and caching, we cannot guarantee that all instances of a file or reference will disappear immediately, even after removal.
- Providing specific, clickable URLs for each instance of the allegedly infringing material greatly improves the accuracy and speed of removal.
- We may update this DMCA & Copyright Policy from time to time. Changes take effect when posted on this page.
